These Terms govern your access to and use of ZenCreator — including the website, app, tools, and all related services. By using ZenCreator, you agree to these Terms. If you don't agree, please don't use the Services.

Who can use ZenCreator

ZenCreator is for adults only. By using the Services, you confirm that:

• You are at least 18 years old

• You have the legal capacity to enter into a binding agreement

• If you're acting on behalf of a company, you're authorized to bind that company to these Terms

• You will comply with all applicable laws and these Terms

We may ask you to verify your identity, age, or authorization at any time. If we can't verify eligibility or compliance, we may suspend or restrict your access.

Your account

To access certain features, you'll need to create an account. You're responsible for keeping your login credentials confidential, restricting access to your account, and everything that happens under your account. If you notice any unauthorized access, let us know immediately.

What you can create — and your responsibilities

Your content and prompts

You're solely responsible for the content you upload, the prompts you give, and how you use, share, or distribute any output generated through ZenCreator.

By using the Services, you confirm that:

• You own or have obtained all necessary rights and permissions for any content you upload or use as input

• Your content and outputs don't infringe on anyone else's rights — including copyright, privacy, publicity, or intellectual property

• Where your content includes a real person's image, likeness, voice, or identity, you have obtained all required permissions for your intended use

Your outputs

Subject to your compliance with these Terms and payment of applicable fees, we grant you a non-exclusive, worldwide license to use, reproduce, display, and commercially exploit the outputs you generate. Keep in mind that AI models may produce similar results for other users based on similar prompts — you won't have exclusive rights to styles or concepts generated through the Services.

What's not allowed

This section is important. Please read it carefully.

Content involving minors

You must never use ZenCreator to create, upload, distribute, or promote:

• Any child sexual abuse material (CSAM)

• Sexualized depictions of minors — real, fictional, or AI-generated

• Any content depicting a person who appears to be under 18 in a sexual context, even if you claim otherwise

If we have reason to believe you've created or distributed such content, your account will be permanently terminated without refund, and we will report the activity to the relevant authorities.

Sexual violence and bestiality

You must not use the Services for any content involving bestiality or sexual violence — including depictions of non-consent, coercion, or similar scenarios, regardless of whether the content is real, fictional, or AI-generated.

Other prohibited content

You also agree not to use ZenCreator for:

• Content that violates any law or regulation

• Infringement of third-party intellectual property rights

• Harassment, threats, or incitement to violence

• Hate speech or content targeting protected groups

• Terrorism or promotion of violent extremism

• Revenge porn, doxxing, or privacy violations

• Fraud, scams, impersonation, or deceptive content

• Malware, phishing, or attempts to compromise security

Real people

You must not use ZenCreator to:

• Create non-consensual intimate imagery of real people

• Use someone's image, likeness, voice, or identity without required permissions

• Impersonate or defame real people

• Create content that violates someone's privacy or publicity rights

Technical restrictions

You must not:

• Attempt to bypass safety limits or technical restrictions in the Services

• Use bots or automated systems to abuse the Services

• Reverse engineer or attempt to extract source code or model weights

Enforcement and account termination

We monitor usage to detect abuse, policy violations, fraud, and legal risks. If we believe you've violated these Terms, we may — without notice:

• Suspend, restrict, or terminate your account

• Remove or refuse to process specific content

• Refuse current or future transactions

• Share relevant information with law enforcement or other authorities where required by law

No refunds for violations. If your account is suspended or terminated due to a Terms violation, you are not entitled to any refund, credit, or compensation for unused credits or time.

Payments and credits

Paid features are available through credit packages or subscriptions. Prices are shown at checkout and may change over time.

• Credits are consumed when a generation starts — used credits are non-refundable

• If your account is terminated due to prohibited use, any remaining balance is forfeited

Payments are processed by our partner Dimeris Ltd and its designated payment providers. Charges may appear on your statement under Dimeris Ltd or ZenCreator.

Intellectual property

All rights to the ZenCreator platform — including software, AI models, interfaces, designs, trademarks, and logos — belong to ZenCreator, LLC or our licensors. You receive only the rights explicitly granted in these Terms.

You may not copy, modify, or create derivative works of the Services, redistribute or sublicense access to third parties, or remove any copyright or proprietary notices.

Disclaimers

ZenCreator is provided "as is" and "as available." We don't guarantee uninterrupted or error-free operation, specific output quality or style, or that all harmful content will be detected and blocked. AI-generated content may be inaccurate, biased, or unexpected — you're responsible for reviewing and deciding how to use any output.

Limitation of liability

To the maximum extent permitted by law, ZenCreator is not liable for indirect, incidental, or consequential damages — including loss of profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid us in the three months before the event giving rise to the claim.

Your responsibility to us

You agree to indemnify and hold ZenCreator harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Services, your content, or your violation of these Terms or any third-party rights.

Third-party services

ZenCreator may integrate with or link to third-party tools and services. We're not responsible for their content, policies, or practices. Use of third-party services is governed by their own terms.

Privacy

Your use of ZenCreator is also governed by our Privacy Policy and Cookies Policy, which explain how we collect, use, and protect your data. For data access, correction, or deletion requests, contact [email protected].

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA. If a dispute arises, we'll first try to resolve it informally. If that's not possible, disputes will be settled by binding arbitration in Dover, Delaware, in English. You and ZenCreator both waive the right to a jury trial or class action, to the extent permitted by law.

Changes to these Terms

We may update these Terms from time to time. We'll update the effective date when we do, and notify you of material changes via the platform or email. Continued use of the Services after an update means you accept the revised Terms.
